Where Is JUUL Sold?

All of JUUL’s products used to be readily available, including in convenience stores, pharmacies, and gas stations. However, in 2018, after pressure from the U.S. Food and Drug Administration (FDA), the company stopped making some of its flavored products readily available.

JUUL is now predominantly sold in vape stores and on the company’s website. Although minors’ access to potentially harmful e-cigarettes is currently restricted, much of the damage to young people and children has already been done. Scores of young adults have become addicted to nicotine and now face devastating mental and physical health consequences.

If you or your child is suffering negative health effects due to the unethical practices of the manufacturer of JUUL, Morgan & Morgan could help. Contact us now for a free and confidential consultation.

What Is JUUL?

JUUL devices are a type of e-cigarette with a “pod” containing nicotine, chemicals, and flavoring. The device, when heated, produces a vapor that dissolves in the air.

Do All JUUL Pods Contain Nicotine?

JUUL does not manufacture any products without nicotine. According to the American Lung Association, one JUUL pod can contain as much nicotine as an entire pack of cigarettes. Nicotine is an addictive substance that may have long-term detrimental consequences on the brain development of children and young adults. However, individuals may not even realize the high nicotine content in JUUL or know that JUUL contains any nicotine at all.

Is JUUL Healthier Than Smoking Cigarettes?

Although e-cigarettes may be less toxic than traditional tobacco products, they still contain harmful chemicals and, in most cases, nicotine. E-cigarettes may also entice young people to smoke cigarettes.

The U.S. Surgeon General has described youth vaping as an epidemic, threatening to cause new levels of nicotine addiction among young people. The number of lawsuits has also been growing, particularly among those who suffered adverse health effects and parents of underage youths who used the product, thinking it was safe.

JUUL Lawsuits

According to the National Law Review, lawsuits against JUUL and other manufacturers allege that e-cigarette makers failed to state the dangerous chemicals in their products.  Ongoing lawsuits further maintain that JUUL’s negligence and false marketing caused youths and others harm, such as addiction issues, lung injuries, heart attacks, and strokes. Moreover, individuals who tried to break their cigarette addiction may have become addicted to JUUL instead due to the high levels of nicotine in the product.

If you have suffered an injury or addiction issues due to using JUUL, you could potentially file or participate in a lawsuit against the manufacturer.

JUUL Marketing Focused on Children and Young Adults

While the potential of JUUL and other e-cigarette brands to provide smokers with a less harmful alternative to tobacco cigarettes is generally a positive step, vape companies have come under attack for the way they have marketed their products.

JUUL, in particular, has focused much of its previous marketing campaigns on young adults and children, arguably enticing them to use the product. These marketing efforts and the fact that JUUL was sold in many stores arguably put children at risk for nicotine addiction and other detrimental health effects. Ways in which the manufacturer of JUUL has focused on a younger demographic include:

  • The company ran advertisements on social media channels and websites overwhelmingly used by minors and young adults.
  • JUUL focused on fruity flavors such as mango, mint, and berries that appeal to younger people rather than those smoking tobacco cigarettes.
  • JUUL devices look like USB sticks, potentially making it easier for minors to conceal them from parents and teachers.

The Dangers of JUUL for Minors and Young Adults

JUUL was previously sold in convenience stores and gas stations, meaning that minors had easy access to the products.  JUUL products also have a relatively high nicotine content which makes them particularly addictive. Unlike other e-cigarette manufacturers, the company does not offer nicotine-free pods. This makes JUUL not only an unhealthy and potentially dangerous choice for young adults but also does little for smokers who intend to wean themselves off their nicotine addiction.

The Risks of Using JUUL and Other E-Cigarettes

E-cigarettes are not very well researched yet, and our knowledge regarding their potentially harmful effects is still limited. However, according to the Centers for Disease Control and Prevention (CDC), we already know that:

Most E-Cigarettes Contain Nicotine

JUUL and other e-cigarettes that contain nicotine can be:

  • Harmful to health
  • Addictive
  • Toxic to fetuses
  • Harmful to the brain development of young people

E-cigarette aerosols can also contain other harmful substances such as cancer-causing chemicals and small particles that could get lodged in the lungs.

There Are Short-Term Side Effects from Using E-Cigarettes

Some of the short-term side effects of using JUUL and e-cigarettes can include:

  • Cough
  • Dry mouth
  • Difficulties breathing
  • Headaches
  • Nausea

Increased nicotine absorption can also potentially cause dizziness, sweating, an increased heart rate and, in some cases, even seizures.

There Are Potential Long-Term Health Effects

According to the American Journal of Managed Care (AJMC), e-cigarette users could develop heart attacks, coronary artery disease, and even experience emotional problems. While research is still ongoing on the long-term harmful effects of JUUL and other e-cigarettes, the evidence we have suggests that the products are linked to a number of additional long-term health issues such as:

  • Lung injuries and diseases
  • Respiratory diseases
  • Strokes
  • Low birth weights
  • Reproductive issues
  • Increased cancer risks
  • Depression
  • Anxiety

E-Cigarettes Can Cause Unintended Injuries

Defective e-cigarette batteries can potentially explode or go up in flames, particularly during the charging process. Some consumers have been seriously injured in such incidents.

JUUL Victims Could Receive Compensation

If you or a family member suffered an addiction or severe injury due to a defective or dangerous e-cigarette, medical expenses can quickly stack up and become unmanageable. In some cases, the only path to justice is filing a lawsuit and holding a manufacturer, distributor, or another liable party to account for your losses.

While compensation cannot restore your health or the health of your child, receiving a payout can help to avert financial chaos. Depending on the facts of a case, victims could receive:

Healthcare Expenses

If you or a loved one came to harm due to using JUUL or other e-cigarettes, you could potentially be entitled to all medical expenses, including the cost of hospital stays, medications, diagnostic tests, surgeries, addiction services, and other medical needs. You could also recover future medical expenses in connection with the injury.

Lost Wages and Diminished Earning Capacity

If you suffered from a debilitating respiratory illness or other devastating health effects from using JUUL and had to take time off work for recovery and medical treatments, you could recover wage losses. Potentially, victims could not only receive the income they already lost but also any future expected income losses. You could also recover compensation for future reduced earning capacity due to your injury.

Pain and Suffering

Monetary losses such as medical bills and lost wages can be relatively easy to calculate. However, if an individual suffered a significant injury, addiction, or medical condition due to e-cigarettes, they might have to deal with ongoing physical pain and emotional distress. Compensation is generally available for such damages.

Based on your specific case, you could also be entitled to other types of compensation. An attorney can assess your case and determine the damages you could recover.

FAQ

Get answers to commonly asked questions about our legal services and learn how we may assist you with your case.

  • Is Vaping More Dangerous Than Smoking?

According to Johns Hopkins Medicine, vaping is potentially less harmful than smoking, but it is still not entirely safe. Regular cigarettes include around 7,000 different chemicals, while e-cigarettes such as JUUL may expose users to fewer toxic chemicals.

However, people who do not currently smoke are encouraged by the CDC to avoid using e-cigarettes as they may not be safe for pregnant women, young adults, children, and those who currently do not use tobacco products. Research into the dangers of e-cigarettes is still ongoing.

  • What Is EVALI?

EVALI stands for a serious lung disease that can develop with vaping and e-cigarette use. Symptoms of EVALI can be flu-like. However, patients can deteriorate and may require hospitalization and a ventilator for breathing. In some cases, EVALI can be fatal. Symptoms that could point to the condition can include:

    • Chest or abdominal pain
    • Diarrhea
    • Coughing
    • Nausea
    • Shortness of breath
    • Fever
    • Vomiting

If you have symptoms of EVALI, seek medical advice as soon as possible and tell your doctor that you use e-cigarettes. You can also consult an attorney as you could potentially file a lawsuit and recover compensation for your medical bills and other expenses.

  • Do I Have a JUUL Case?

If you or a loved one developed serious lung disease, stroke, seizures, or another condition due to smoking JUUL or other e-cigarettes, you could have a case. There are also ongoing lawsuits alleging that JUUL aimed their product marketing towards children and young adults, contributing to nicotine addiction and other health issues. If you think you could have a case, one of our attorneys or legal team members can walk you through your options in a free consultation.

If you are the parent or legal guardian of a child that suffered from nicotine addiction or another adverse health effect due to JUUL, you could potentially file a lawsuit on the harmed minor’s behalf. An attorney from our firm can help you navigate the legal process.

  • What Are the Time Limits for JUUL Lawsuits?

Most states have time limits for personal injury lawsuits against JUUL or other e-cigarette manufacturers. However, those time limits vary from one state to another and can be as short as one year or as long as four years. When you discover an injury or condition that could have occurred due to using e-cigarettes, consult with an experienced personal injury attorney for help and advice. The sooner you get legal advice and guidance, the sooner you could receive what you deserve.

  • Do I Have to Go to Court for a JUUL Lawsuit?

Most personal injury lawsuits settle before trial. The chances that you have to go to court are small. Out-of-court settlements can be advantageous to both parties as they are typically resolved faster, guarantee a payout to the injured party, and are generally less expensive. In theory, two parties can reach a settlement at any time before a trial.

However, an out-of-court settlement is not guaranteed. Therefore, anyone who files a lawsuit should be prepared to go all the way to trial if necessary.
